Part I National Surveys
A Comparative Survey of Private Sector Liability for Grave Violations
of International Law in National Jurisdictions provides a much-needed
comparative survey of the relevant national legislation in selected countries
concerning business entities' liability under domestic civil and criminal
law for the commission, or complicity in the commission, of violations
of international criminal and humanitarian law, both in and beyond national
jurisdictions.
The countries were surveyed in 2003 and include Canada, France, Norway,
the United Kingdom, and the United States. They were selected because
these jurisdictions are home to the vast majority of multinational enterprises
and because, as they are advanced democracies with highly developed legal
systems, surveying their legal and institutional capacity to address the
critical questions of private sector liability for international crimes
allows for a reliable assessment of the current state of relevant law.
They also allow an assessment of both civil law and common law systems.
Though the survey is limited to these five countries, we recognize that
we have excluded other important jurisdictions, both in the developed
and developing world. We hope that this work stimulates similar assessments
elsewhere.
